PUBLIC NOTICE - HEMPHILL COUNTY UNDERGROUND WATER CONSERVATION DISTRICT

NOTICE OF PROPOSED ACTION 
ON APPLICATION FOR PRODUCTION PERMIT

The Hemphill County Underground Water Conservation District (“District”) General Manager proposes to grant an application by Peyton Ranch, LLC, 105 N 5th, Canadian, TX 79014, (“Applicant”) for a new Large Production Well Permit authorizing: (1) annual withdrawal up to 690 acre-feet of groundwater from the Ogallala Aquifer for Irrigation using a proposed turbine, natural gas well located in the NW ¼ of Section 99, Block 41 of H&TC Survey at Latitude 35º 49’ 52.2834” and Longitude -100º 4’ 35.5994”, and; (2) annual withdrawal of up to 360 acre-feet of groundwater from the Ogallala Aquifer for Irrigation using a proposed turbine, natural gas well located in the NE ¼ of Section 98, Block 41 of Survey H&TC at Latitude 35º 50’ 10.8234” and Longitude -100º 4’ 59.7”, Hemphill County, Texas.

The General Manager’s Technical Summary and Proposed Action recommends issuing a new Large Production Well Permit to the Applicant, subject to the District’s standard permit conditions, as described in District Rule § 5.125. The application was determined to be administratively complete on July 17, 2025. The proposed well meets the District’s spacing rules and authorization to drill the well is provided in Drilling Permit C100-120 and C100-121. Under the proposed permit, the annual allowed decline is 1.66 and 1.11 feet per year, respectively. 

Copies of the Permit Application and the General Manager’s Technical Summary and Proposed Action (including the proposed permit and conditions), and supporting documentation are available for inspection by the public at the District’s offices.

The proposed action will be presented to the Board for final action at a Board meeting conducted under the Texas Open Meetings Act no later than 60 days from the date of publication of this notice, unless, under District Rule § 9.607, the applicant, other applicants, other registrants (pending or approved), or another permittee files a request for contested case hearing with the District no later than 30 days after the date of publication of this notice, in which case the matter may be referred to a contested case hearing.
