LETTER: Congress is making it illegal to regulate AI in our government

Buried deep in H.R. 1 [the One Big Beautiful Bill Act] is a clause that would prohibit any state or local government from regulating artificial intelligence for the next 10 years. That includes the use of AI in law enforcement, hiring practices, surveillance, education, and even social services. The only exception? If a law helps implement AI faster. 

That’s not innovation.  It's a rubber stamp.

You should be concerned. This should deeply concern our representatives in Congress: Ronny Jackson, Ted Cruz, and John Cornyn.

EXACT WORDING IN THE BILL (page 292):

(c) MORATORIUM.— 
(1) IN GENERAL.—Except as provided in paragraph (2), no State or political subdivision thereof may enforce any law or regulation regulating artificial intelligence models, artificial intelligence systems, or automated decision systems during the 10-year period beginning on the date of the enactment of this Act.

Thomas Sowell, in Basic Economics, made the main point: "Think Past Step One."

Ask yourself: “What happens when my party is no longer in power?”

If enacted, this moratorium would give unelected bureaucrats and political appointees a decade-long free pass to roll out AI systems without public accountability. We’re not just talking about theoretical risks.

Imagine a future administration using AI to score and penalize local governments based on political leanings. Now imagine not being allowed to pass any law to stop it.

If this part of the budget bill is allowed.  You won’t be able to pass a state or federal law that regulates AI systems in our government.

Put aside the “culture war.” Put aside “the budget.” Put aside the rhetoric about “making the federal government smaller.”

This is a serious concern that transcends political parties. Whether you lean right or left, you deserve to have a say in how powerful new technologies are deployed. Especially when they can be used by governments with little oversight.

Please contact your representatives and tell them: “This ‘AI Law Moratorium” should not be in the budget.”
